TERMS AND CONDITIONS OF SUPPLY OF SERVICES
The Customer Acknowledges that the operator Board Sign Hub trading under the identity of Fleur Signs Ltd.
General
1.1 In the following Terms & Conditions, the following meanings shall apply.
THE CUSTOMER: The individual, partnership, or company as named on the digital contract (as agreed by entering an instruction on the online board ordering and management system portal)
FLEUR SIGNS LTD: The business is licensed to trade as FLEUR SIGNS LTD
1.2 The Customer shall provide all instructions in respect of the erection, maintenance, and retrieval of signboards via Fleur Signs Ltd.’s online system.
1.3 All invoices will be raised by Fleur Signs Ltd to whom all debts will be assigned, and to whom payment should be made by BACS transfer.
1.4 All invoices will be sent to the Customer's nominated email address and are due for payment within 28 days of the invoice date.
1.5 In the event that the full sum is not paid by the due date, we reserve the right to charge a flat rate per month for additional administration costs.
1.6 All charges are exclusive of standard rate VAT.
1.7 Our prices are reviewed annually on 1st May, and any price increase is applied to any work completed from 1st June. The announcement of any price rise is communicated through the online portal notifications. Analysis of CPI (Consumer Price Index) percentage change over the previous 12 months is used to calculate a price increase if applicable.
1.8 This agreement is made under English law and shall be subject to the exclusive jurisdiction of the English courts.
Liability
2.1 The Customer shall obtain permission from the property owner for the erection of the signboard(s) prior to instructions being given to Fleur Signs Ltd
2.2 The Operator will take every care to avoid causing damage when erecting a signboard; however, Fleur Signs Ltd is unable to accept any liability for any damage to property unless apportioned to the negligence of Fleur Signs Ltd.
Fleur Signs Ltd will not affix signs or fixings to door frames, window frames, brittle substances or rendered surfaces without the prior permission of the property owner. This will be achieved by selecting 'Drill Permission' when ordering the job; therefore, permitting the making of that fixing. Fleur Signs Ltd will not be responsible for any property damage, however caused.
2.3 Fleur Signs Ltd will affix or erect signboards up to a maximum height of 5m and at all times maintain Public Liability insurance (£5,000,000) in respect of products and services supplied.
2.4 Fleur Signs Ltd cannot accept any liability whatsoever for any signs, posts or fixings not erected or serviced by themselves or when a sign has been moved or tampered with by the Customer, the property owner or any third party.
2.5 The Customer accepts sole responsibility for complying with all relevant legal or planning requirements in connection with the erection of any board and further agrees to indemnify Fleur Signs Ltd in respect of any breach of, or failure to comply with, such requirements.
Terms
3.1 The minimum period for the supply of service is twelve months. At the end of this period, this agreement shall continue, subject to any agreed price alteration, and the Customer shall give a minimum of three months' written notice of a wish to discontinue use of the service.
3.2 The Customer hereby covenants that Fleur Signs Ltd shall be their sole signboard contractor/erector throughout both the initial and notice periods.
3.3 Should an agent wish to terminate their use of Fleur Signs Ltd, any angle irons or posts provided on a rental basis (unless supplied by the agent) will be charged respectively.
3.4 Fleur Signs Ltd retains the right to hold any stock of an existing customer until all invoices are paid and the service period has been served (or withdrawn by agreement)
3.5 Fleur Signs Ltd prices are subject to change, and any increase shall be notified to the customer in writing in advance (see section 1.7)
Services
4.1 Fleur Signs Ltd shall store a reasonable quantity of stock on behalf of the customer, and the customer shall be responsible for ensuring that Fleur Signs Ltd. holds sufficient quantities of stock when notified of low levels of stock.
4.2 Fleur Signs Ltd shall erect the boards on stakes at an address (such address being within a 10-mile driving radius) as measured by Google Maps, provided by the customer through an online database within 48 hours of instruction.
4.3 Order shall be made by the online database only.
4.4 The price for working outside of the normal area as described in section 4.2 increases the standard visit fee. This charge is only levied for time spent outside of the agreed radius.
4.5 Please note that estate agent boards are temporary fixings and should be checked on a regular basis by the homeowners, tenants and by the agent.
4.6 If any movement is seen the agent should immediately instruct Fleur Signs Ltd to check on the boards using the ‘Re-Erect Board’ instruction.
4.7 All boards should be taken down within a maximum of 2 weeks after completion, as dictated by the Town and Country Planning Regulations. It is the Agent’s responsibility to instruct these boards to be removed.
4.8 Estate agent boards are temporary fixings and should be checked regularly by the homeowners, tenants, and you, the agent. If any movement is seen, an order should be placed immediately to rectify the situation.
When Fleur Signs Ltd installs a board, it will be in the most suitable position, but if there are winds or vandalism, we cannot be held responsible for any damage caused. Walls and fences will become weaker over a period as general weather conditions will cause the boards to move. This is especially true in extreme weather conditions. The potential position for board erection should be considered by the agent before placing the order. If fixing to brickwork is the only viable option, the agent accepts the responsibility for any damage caused by fixing to brickwork by placing the order on the system and selecting 'Yes' in the drill permission field.
4.9 If a vendor is unhappy about the position a board has been erected in, an order should be immediately placed to move this board. If no order is placed, it is assumed that the board placement is deemed suitable by the vendor, and therefore any future damage caused by external forces becomes the responsibility of the vendor.
